John McFarland erases $2.1 million award of lost profits from judgment against University General Hospital.
The 14th Court of Appeals reformed a judgment rendered against John McFarland’s client University General Hospital to strike the $2.1 million award for future lost profits award awarded to the plaintiff, Prexus. Through breach of contract and related claims, Prexus sought approximately $22 million in damages. The trial court awarded just $745,000 in past damages and the now-struck $2.1 million in lost profits; Prexus took nothing on its other claims. Ben Wickert tried the case with John and, along with Akin Gump’s Murry Cohen, assisted with the appeal.
